Starting from January 11, 2025, the U.S. Customs and Border Protection (CBP) will begin to fully enforce the 321 provision — which is the regulation regarding the “minimum duty-free declaration amount (de minimis).”

The regulation requires that goods entering the country with the minimum tax-free declaration amount standard must meet the following conditions:

1. The value is less than 800 US dollars.

2. The minimum tax-free declaration amount of 800 US dollars applies to the import volume of each importer (a company or an individual) in the United States per day.

3. Regardless of the transportation mode used, the consolidation of shipments to the same importer will be considered a single import. If the total value of all shipments exceeds 800 US dollars, a taxable customs declaration is required.

4. The importer must indicate the value of the goods on the bill of lading or similar documents (e.g., manifest).

5. This regulation applies to all transportation modes, carriers, and entry types of the goods.

Please refer to the CBP official website for specific regulations, and take the content published on the official website as the standard.

Please be informed that if the imported goods exceed the daily duty-free quota standards, your goods will be subject to formal or informal entry declarations as determined by the U.S. CBP. In this case, customs may impose applicable duties and taxes on your goods, and corresponding customs declaration fees and other related logistics additional charges may also arise. These charges will be collected from the sender or recipient according to the terms of the goods invoice. In the event of non-payment, the fees and liabilities will be handled according to the relevant service terms and rules.

If the daily tax-free quota standard is to be circumvented by deliberately failing to report or altering the declaration information of the goods, it may result in the detention or delay in customs clearance of the goods, and any liability arising therefrom shall be borne by the sender or recipient at their own expense.

Suggested action points: Please fill in the declaration information of the goods truthfully, and actively cooperate with the logistics service provider when notified to declare taxable goods, in order to reduce the possibility of the goods being detained or delayed during customs clearance.
